University of Idaho Law Student Drafts Bill to Prohibit Human Remains Sales in Idaho

A University of Idaho law student has turned a personal policy goal into proposed legislation, drafting a bill that would ban the sale of human remains in Idaho.

Desalyn Swank told the Times-News protecting the deceased from exploitation has been a driving motivation since she enrolled in law school. She told the Magic Valley that her aim is “to protect those that have passed that are being taken advantage of.”

Swank entered law school with the explicit intent of reforming state law, and the proposed measure reflects that ambition. The bill would prohibit commercial transactions involving human remains within Idaho — an area where current state law leaves gaps in consumer and posthumous-persons protections.

No legislative timeline has been announced for the proposal, and it would need to be formally introduced during a future Idaho legislative session before advancing through committee review and floor consideration.
